Terms of Service (ToS — Terms of Service)

Welcome to riteperformance.com (the “Site”), operated by RITE Labs, LLC (“RITE,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, joining Priority Access, or subscribing, you agree to these Terms of Service.

If you do not agree, please do not use the Site.

1) Eligibility & your account

  • You must be 18 or older to purchase or join Priority Access.

  • You are responsible for the accuracy of the information you provide and for keeping your device and email secure.

2) Health & safety disclaimers

  • RITE products are dietary supplements, not medicines. These statements have not been evaluated by the Food and Drug Administration (FDA — Food and Drug Administration). This product is not intended to diagnose, treat, cure, or prevent any disease.

  • Information on the Site is general information, not medical advice. Consult a healthcare professional before use, especially if you have a condition, are taking medication, are pregnant or nursing, or have allergies.

  • Individual results vary. Stop use and contact a healthcare professional if you experience any adverse reaction.

3) Orders, pricing, and availability

  • We may refuse or cancel any order (for example, suspected fraud or mispricing). If your card was charged for a canceled order, we’ll refund you.

  • Prices, promotions, and product details may change without notice. Taxes and shipping are shown at checkout.

4) Batch releases, Priority Access, and preorders

  • We release inventory in limited-run batches (for example, “Batch 007”). Batch capacity indicators (for example, “81% reserved”) reflect current planning and may be approximate.

  • Priority Access places you on a list to be notified when your purchase window opens. A Priority Access spot is not a purchase and doesn’t guarantee delivery dates.

  • Preorders: If you place a preorder, your card may be authorized at checkout and charged when we confirm your allocation or as disclosed during checkout. Estimated ship windows are estimates, not guarantees. You can cancel a preorder any time before it ships by emailing support@riteperformance.com with your order number.

5) Shipping, risk of loss, and delivery issues

  • We ship to the address you provide. Please double-check it.

  • Risk of loss passes to you upon delivery to the carrier. Tracking will be provided when available.

  • If a package is marked delivered but you cannot locate it, notify us within 7 days; we’ll help investigate. Replacements or refunds for lost or stolen packages are handled case by case.

6) Returns & refunds

Our Return Policy is part of these Terms. Please see /returns for details. Highlights:

  • 30-day no-hassle refund from the date your package is marked delivered.

  • First order (one unit): opened bottle refundable without return (photo + lot code requested).

  • Unopened items: refundable upon return in original condition (you cover return shipping).

  • Shipping fees are non-refundable unless we made an error.

  • For damaged/incorrect items, contact us within 7 days of delivery with photos—we’ll replace or refund.

7) Subscriptions (when enabled)

  • Subscriptions skip the batch waitlist; we reserve inventory for your cadence (for example, every 30 / 45 / 60 days).

  • We email a reminder ~48 hours before each renewal. You may pause, skip, change date, or cancel any time before the renewal processes.

  • Once a renewal processes, the order enters fulfillment. Unopened subscription items are refundable under the Return Policy; opened renewal items are not refundable except for damaged/incorrect shipments.

  • If a severe shortage delays your renewal, we’ll email options: ship partial/next-available, delay, or refund.

  • If subscriber pricing changes, we’ll notify you at least 14 days in advance; you may cancel before the change takes effect.

8) Promotions, coupons, and bundles

  • Promotions are limited-time, cannot be combined unless stated, and may be changed or canceled without notice.

  • If a promotion requires a minimum purchase or specific items, returns may affect the promotional value of your order.

9) User reviews and submissions

  • We love feedback. By submitting a review, photo, or comment, you grant RITE a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it for marketing and operations.

  • You agree your submissions are truthful, based on your individual experience, and do not infringe others’ rights or contain unlawful content. We may moderate or remove content at our discretion.

  • Individual results vary. Some early reviews may be from friends/family testers; we disclose this where posted.

10) Acceptable use

You agree not to:

  • violate any law or these Terms;

  • attempt to interfere with the Site’s security or operation;

  • use bots or scraping tools without permission;

  • purchase for resale without our written approval.

11) Intellectual property

  • The Site, brand names, logos, product names, text, images, and code are owned by or licensed to RITE and protected by law.

  • You may not use our trademarks without written permission, except for lawful nominative fair use.

12) Third-party links, services, and pixels

  • The Site may link to third-party sites or use third-party tools (for example, the TikTok Pixel). We do not control those services. Your use of them is governed by their terms and policies.

  • Our Privacy Policy (see /privacy-policy) explains how we use cookies and pixels and your choices.

13) Disclaimer of warranties

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that the Site is free of viruses or other harmful components.

14) Limitation of liability

To the fullest extent permitted by law, RITE and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, exemplary, or consequential damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Site or products—even if advised of the possibility.
Our total liability for any claim relating to the Site or a product will not exceed the amount you paid to RITE for the product or the one-month portion of a subscription giving rise to the claim, whichever is less. Some jurisdictions do not allow certain limitations; in those places, our liability will be limited to the maximum extent permitted.

15) Indemnification

You agree to indemnify and hold harmless RITE from and against any claims, demands, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your misuse of the Site or products, (b) your violation of these Terms, or (c) your violation of any law or third-party rights.

16) Dispute resolution; arbitration; class action waiver

To keep things efficient, you and RITE agree that any dispute arising from these Terms or the Site/products will be resolved by binding arbitration on an individual basis, except you may bring a claim in small-claims court if eligible. Class actions and class arbitrations are not permitted.

  • Arbitration will be administered by a recognized provider under its consumer rules.

  • You and RITE each pay your own fees unless rules or law say otherwise.

  • You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@riteperformance.com with subject “Arbitration Opt-Out” and your full name and address.
    If arbitration is not enforceable for a claim, the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Orange County, California, and to California law (without regard to conflicts rules).

17) Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles and subject to the consumer protections of your state or country of residence where applicable.

18) Changes to these Terms

We may update these Terms from time to time. We will post the new Effective Date when we do. Your continued use of the Site after changes means you accept the updated Terms.
